THOUGHTS ON HOW TO HOST AN EVENT DURING THE COVID-19 PANDEMIC

During the Covid-19 pandemic, people have been asking me about how to set up fundraising, volunteer, and charity events to give back while still maintaining appropriate legal protections. Some people are forced to return to work and need to protect their company from liability if third parties enter their premises. Here is a general list of provisions, specific to this pandemic, that you can incorporate into any Waiver & Release documents:

1. Declaration that the relationship is one of volunteer or guest, not an employee mandated to attend, and that individuals are attending at their own discretion and risk.

2. Individuals declare they are free to leave at any time without any recourse/punishment.

3. Individuals are attending of their own accord and aware of the current risks associated with being in gatherings due to Covid-19.

4. Individuals are not Covid positive or experiencing symptoms of Covid at the moment or in the past ten to fourteen days (listing symptoms here can be helpful).

5. Acknowledgement that all protocols published by the Governor’s Office and Dep’t of Public Health are being followed at the event such as social distancing and use of PPE (a list here can be helpful as well).

6. Waiver of claims, including personal injury from Covid.

7. Binding nature on successors.

8. Agreement to indemnify the event host/managers from third party claims brought due to attendees being exposed to illness while at the event.

We can help you tailor a document that specifically serves your individual needs. The list above is just that, a list, to add to your existing waivers or contracts but is by no means sufficient to create any legally binding document. Hope everyone stays safe ++
